Tegucigalpa.- El día de hoy, el Congreso Nacional tiene programado elegir al próximo Fiscal General entre cinco candidaturas presentadas por la Junta Proponente, además deberá elegir Fiscal adjunto. Desde el Centro por la Justicia y el Derecho Internacional (CEJIL) se suman a los actores y organizaciones que han expresado su preocupación ante las deficiencias del proceso que se ha seguido para el nombramiento de estos cargos.
Por una parte, se desconoce cuáles fueron los criterios utilizados en este proceso para analizar las candidaturas y seleccionar la terna enviada al Congreso, esto es abiertamente contrario a los estándares internacionales.
Adicionalmente, tal como sostiene el Alto Comisionado de las Naciones Unidas para los Derechos Humanos en Honduras (OACNUDH – Honduras), en este proceso no se ha cumplido con los principios de publicidad y transparencia. Resulta preocupante que la sociedad civil no tenga una representación legítima en la Junta proponente debido a una normativa que ha sido cuestionada constitucionalmente.
Otra irregularidad grave es la inminente participación de miembros del Congreso Nacional investigados por actos de corrupción en la selección de quien estaría al frente de investigarles. Este evidente conflicto de interés debe ser censurado.
Recuerdan además que, según afirma la Comisión Interamericana de Derechos Humanos (CIDH), el rol de Fiscal General es vital “para el acceso a la justicia, la preservación del Estado de Derecho, la lucha contra la impunidad, y la defensa de los derechos humanos”. A raíz de lo anterior, un proceso adecuado de nombramiento de la persona que encabezará el Ministerio Público “constituye un presupuesto esencial para garantizar la independencia de las y los operadores de justicia”.
Lamentablemente, como es usual en Honduras para este tipo de nombramientos, no hay garantías que la selección de quien liderará la Fiscalía General cumpla con estos objetivos.
Ante este contexto, hicieron un llamado al Estado para que revise integralmente el proceso de selección, cuyo plazo se puede extender hasta finales de agosto, de manera de que éste cumpla con los más altos estándares internacionales interamericanos en la materia.
Entre ellos, resaltan:
Garantizar que la selección ocurra con base en méritos personales, capacidad profesional e idoneidad;
aplicar criterios objetivos de evaluación.
Dar a conocer de manera pública y transparente los requisitos y criterios de selección para permitir el escrutinio de los sectores sociales y permitir la participación amplia de la sociedad civil organizada.
Demandan, además, que los y las diputadas que enfrentan procesos por casos de corrupción se abstengan de participar en la selección del Fiscal General y Fiscal General adjunto.
Por último, destacan que la persona electa como titular del Ministerio Público debe demostrar un reconocido e indiscutible compromiso con la garantía de los derechos humanos, el combate contra la impunidad, y la lucha contra la corrupción en Honduras. Todas las personas que postulen sus nombres deben hacer público su compromiso con estos principios irrenunciables.
Quien encabece el Ministerio Público en el país debe hacerlo a la altura de las necesidades y desafíos que el país enfrenta. Si se quiere aportar a la construcción de un verdadero Estado de derecho, este proceso de elección se debe realizar libre de indebidas injerencias, manifesto CEJIL en un comunicado público.
