Tegucigalpa.- La política editorial que han asumido la mayoría de los medios de comunicación en Honduras para favorecer al gobierno, al ensalzar cada una de sus políticas y acompañar al presidente Juan Hernández, en cada uno de sus propósitos, poco o nunca se ha puesto en la palestra pública por la indiferencia, complicidad o por el simple hecho de desconocer las verdaderas razones.
Quienes se preguntan qué es lo que realmente está pasando con la agenda mediática son pocos, e incluso, este tema ha sido invisibilizado por aquellos organismos que trabajan en la defensa de la libertad de expresión y de prensa, que se han ido más a los efectos que a las causas.
De momento a la única organización que hemos visto que ha tocado el asunto es el Instituto Centroamericano de Estudios Fiscales (Icefi), que en el informe “Perfiles Macrofiscales de Centroamérica”, presentado el año pasado hizo hincapié en el asunto y lo catalogó como un abuso y la fomentación de clases privilegiadas en detrimento del resto de la sociedad hondureña.
Otra de las pocas voces disonantes es la del expresidente del Partido Anticorrupción (PAC) ahora candidato presidencial de la Alianza Opositora Contra la Dictadura, Salvador Nasralla, que al hacer un análisis del contexto ha llegado a la conclusión que el gobierno está pagando a los medios “para ensalzar la figura del presidente Juan Hernández e impulsarlo en una eventual reelección presidencial y por eso no cuestionan nada, ni critican lo malo”.
El también controversial cronista deportivo, ha exigido en varias oportunidades al gobierno que dé una explicación sobre el millonario gasto publicitario y también ha pedido al Tribunal Superior de Cuentas (TSC) que se pronuncie al respecto e investigue el asunto, que a su juicio es otro acto de corrupción de la actual administración.
Por haber asumido esta postura, Nasralla, ha sembrado resquemores en los propietarios de medios, directores, jefes de redacción, editores e incluso en periodistas alineados al sistema.
¿Pero por qué callan los medios?
La anterior interrogante tiene una respuesta sencilla y es la siguiente:
A raíz de la aprobación en el Congreso Nacional del decreto 86-2013 que contempla Ley del Programa Voluntariado de Rescate, Promoción y Fomento del Sector de las Comunicaciones, los medios de comunicación han sido acogidos a un régimen especial que les permite canjear sus deudas concernientes al pago de impuestos y de servicios públicos y sus obligaciones presentes y futuras por dichos conceptos.
Los periodistas que cubren casa presidencial deben sujetarse a la agenda del gobernante de lo contrario son acosados y no tomados en cuenta.
“Los valores que correspondan a cualquier tipo de publicidad que el Gobierno de la República solicite a cualquier operador, o persona natural o jurídica en el convenio regulador específico y dentro del marco de la presente Ley, podrán ser canjeables por pagos de cualquier tipo de impuestos, tasas, pago de permisos, cánones, servicios públicos, licencias o cualquier otro tipo de multas, recargos, intereses moratorios y otros conceptos u obligaciones financieras con el Estado ya sea ésta pasada, presente o futura”, estipula el artículo dos de la normativa.

La normativa fue aprobada en el Congreso Nacional en el 2013, cuando este poder del Estado era presidido por el ahora presidente de la República, quien en aquel entonces buscaba llegar a la máxima magistratura del país, por lo que es más que evidente, que tejió una estrategia para tener el control absoluto de los medios de comunicación.
Hernández impulsó la ley, aprovechando una cruzada iniciada por el expresidente, Porfirio Lobo Sosa, quien proponía una nueva Ley de Telecomunicaciones que planteaba la democratización en el otorgamiento de frecuencias del espectro radioeléctrico.
El planteamiento de Lobo Sosa—que tampoco se descarta como una estrategia para favorecer los propósitos de Hernández—fue rechazado por los dueños de las corporaciones mediáticas de radio, televisión y prensa escrita, que alegaron que se quería imponer una “ley mordaza”, lo que aprovecharon porque al final se salieron con la suya al lograr negociar con el ahora mandatario.
LO QUE SE NEGOCIÓ
En ese legajo de negociaciones se estableció que “las personas naturales o jurídicas dedicadas a la comunicación social, como ser: radio, televisión, medios escritos, digitales y de publicidad en general en cualquier forma de conformidad a la Ley o cualquier otra legislación vigente aplicable, que al momento de la entrada en vigencia de esta Ley y tengan deudas pendientes con el Estado por concepto de impuestos, tasas, permisos, licencias, servicios públicos, multas recargos o cualquier otro concepto de obligación financiera con el Estado ya sea ésta pasada, presente o futura, podrán acogerse voluntariamente a los beneficios del Programa Voluntario de Rescate del Sector de las Comunicaciones creado en esta Ley”.
Lo anterior nos deja claro que los empresarios de los medios de comunicación han quedado exonerados de todo tipo de obligaciones con el Estado, pues lo único que se excluyó es el pago de las aportaciones patronales a los institutos de previsión, al Instituto Hondureño del Seguro Social (I.H.S.S.) u otras instituciones de seguridad social.
Sin bastarles lo anterior, los dueños de medios también lograron, de acuerdo al artículo dos, que podrán canjear el pago de la deuda exigible a favor del Estado con publicidad, “en la forma en que se establezca exclusivamente con el Presidente de la República o a quien éste delegue”.
Lo antes expuesto nos evidencia que la aplicación de la prerrogativa queda exclusivamente en manos del presidente de la República, bajo sus criterios de discrecionalidad. Lógico este se circunscribe a aquellos medios que se han plegado al gobierno, no así aquellos que mantienen una agenda independiente.
De acuerdo a la ley, la publicidad canjeable servirá para la promoción de valores, campañas sociales, educativas o actividades similares a cargo de organizaciones no gubernamentales.
En el mismo artículo dos se establece que “para los fines de la presente Ley, los operadores o empresas que se acojan a la misma deberán firmar un convenio con la Presidencia de la República donde se detallen los acuerdos y establezca los arreglos de ejecución particulares para la correcta implementación, control y seguimiento de cada caso”.
Por otra parte, estipula que las notas de crédito, créditos fiscales o cualquier otro instrumento que el Gobierno emita a través de la Presidencia de la República y represente los valores de la publicidad adquirida por el Estado, serán transferibles, canjeables y negociables. Los operadores pueden traspasar los créditos fiscales que adquieran con el Estado en el marco de esta Ley a empresas o sociedades relacionadas al operador, y podrán usarse para el pago del Impuesto Sobre la Renta o cualquier otro impuesto que deba pagarse al Estado.
